Learn the difference between a complaint and a complaint in accordance with the law
Many citizens are unaware of the provisions of the law, which makes them vulnerable to problems and within the framework of tackling the problem of the terrible increase in the number of cases and to simplify the course of procedures to reduce the shoulders of the judiciary, we review the difference between the complaint and the communication according to the law.
The complaint:
The complaint is the crimes that cannot be initiated except on the basis of a complaint from the concerned and has a period of limitation that is 3 months from the date of knowledge of the crime, and the legislator organized its provisions in Article 10 of the Criminal Procedures Law, where the criminal lawsuit for the following crimes may not be filed except on the basis of a complaint Written or oral, of the victim or his legal representative, including:
1- Theft, fraud, breach of trust, and concealment of the things obtained from it if the victim was the husband of the offender, or if he was one of his assets or branches and these things were not judicially, administratively, or burdened with another person’s right.
2- Not to hand over the child to the person who has the right to request it, and remove it from the authority of the person who takes over it and guarantees it.
3- Refraining from paying the alimony, fare, custody or dwelling adjudicated.
4- Insulting and slandering people.
5- Other crimes stipulated by law.
The complaint shall not be accepted after three months from the day the victim knows about the crime and its perpetrator, unless the law stipulates otherwise.
The notice:
To inform the competent authorities (the police or the prosecution) about the occurrence of a crime, which is the right of any person against whom a crime has been committed or witnesses of the crime, which is an administrative procedure that entails the registration of a new lawsuit.
